In July 2023, the Wyoming Gaming Commission investigated the fantasy pick ‘em model and determined that player-vs-house prediction contests meet the state’s definition of “sports betting.”
The Commission sent cease-and-desist letters to several operators, ordering them to stop offering fantasy pick ‘em contests in Wyoming. The letters explained that pick ‘em contests qualify as online sports betting, which requires licensure in Wyoming.
Daily fantasy sports sites active in Wyoming at the time complied with the order and ceased all pick ‘em contests.
Several major DFS operators regained access to the Wyoming fantasy sports market after developing peer-to-peer variants of their pick ‘em contests and receiving the Commission’s approval.

Wyoming Fantasy Sports Law
Wyoming authorized DFS contests in 2021 when it legalized sports betting via HB 133.
The bill dealt primarily with sports betting in Wyoming, so it contained no DFS-specific regulations. As a result, Wyoming law only addresses fantasy sports to a limited extent:
- Wyo. Stat. § 6-7-101 exempts fantasy sports contests from the state’s definition of “gambling.”
- Wyo. Stat. § 9-24-101 defines “fantasy sports contests” with UIGEA-compliant language
Wyoming fantasy sports sites operated openly before 2021 without issue, so the bill was more of a formality than anything. Nonetheless, it provided legal clarity to operators and mitigated the risk of local authorities changing their interpretation of the law sometime in the future.
