New Mexico has never passed legislation to authorize or prohibit daily fantasy sports. For years, New Mexicoโ€™s silence on the legality of real-money DFS contests allowed all major apps to operate openly without much attention from regulators.

That changed in late 2025, when Attorney General Raรบl Torrez issued a formal opinion at the request of the New Mexico Gaming Control Board. The Board had asked whether apps like DraftKings and FanDuel violate state gambling law.

Torrez reached an inconclusive verdict: New Mexicoโ€™s Gaming Control Act does not authorize daily fantasy sport contests, and a court would have to weigh in on whether they meet the stateโ€™s definition of illegal gambling.

The opinion laid out several reasons why a court could find certain types of DFS contests illegal under current law, but it stopped short of declaring them illegal.

For New Mexico players, little has changed since then. The opinion is not binding, and no enforcement action has followed. To date, every prominent DFS app remains available in New Mexico.
