Kentucky fantasy sports sites operate in a legal gray area because the state has not passed legislation to regulate or explicitly authorize DFS contests.

Legal Kentucky DFS Sites

Kentucky Fantasy Sports Laws
Over the years, the Kentucky legislature has seen multiple fantasy sports bills come and go, but none received enough votes to become law.
The first Kentucky fantasy sports bill appeared in 2017 when lawmakers introduced HB 414. The bill made it to a full House vote and received a favorable vote of 37-36, but that was short of the 40 votes required to send it to the Senate for consideration.
If successful, HB 414 would have been an excellent bill for the daily fantasy industry. It sought initial licensing and annual renewal fees of just $5,000 and established a tax rate of 6%.
Furthermore, if the tax bill for the year was more than $5,000, the initial registration or annual renewal fee could be used to offset the taxes due.
After the Supreme Court overturned PASPA in 2018, subsequent DFS legalization efforts materialized as parts of broader bills seeking to legalize online casinos, poker, and sports betting in Kentucky.
Several of the later attempts included:
- HB 175 (2023): Would have legalized and regulated fantasy sports, online poker, and sports betting (introduced in the House but died shortly after arrival)
- HB 106 (2023): Would have legalized daily fantasy sports, online poker, and sports wagering (introduced in the House and died shortly thereafter with no action)
- HB 606 (2022): Would have legalized daily fantasy sports, online poker, and sports wagering (passed a House vote but died in the Senate)
Most Kentucky lawmakers seem comfortable with the idea of legalization. However, all past DFS legalization bills died due to disagreements over other parts of the bills concerning sports betting and online poker.
Since Kentucky legalized sports betting, lawmakers seem less interested in passing legislation to regulate DFS contests.
