Third-party couriers like Jackpocket and TheLotter once allowed players to buy Texas Lottery tickets online, but the state banned all couriers in early 2025.

In a press release, the Texas Lottery Commission explained that it had revised its policy due to concerns raised by players and state leadership regarding the opaque processes by which couriers fulfill customers’ orders.

The policy update came after a player won an $83 million jackpot from a Texas Lottery ticket purchased through a third-party courier, which caught Lieutenant Governor Patrick’s attention. Patrick visited the retail location the courier used to fulfill the winner’s ticket order and became concerned when he learned that the courier owned the retailer.

Although it’s standard practice for large couriers to acquire lottery retailer licenses in order to handle high order volumes, Patrick found the lack of transparency unacceptable and posted a video on social media voicing his concerns. Days later, the Texas Lottery announced its decision to ban all third-party couriers.

The Texas Lottery never officially endorsed online ticket sales, but it was aware of third-party couriers and seemed to appreciate the additional sales they generated.

In the Texas Lottery’s 2023-2027 Strategic Plan, the lottery said this about courier services:

Another development that is impacting lottery sales is the emergence of courier service companies. These companies take orders on a mobile app to purchase lottery tickets from brick-and-mortar retailers for their customers. Courier service is a private business activity that occurs outside the regulated ticket purchase process.

Couriers have no business relationship with the Texas Lottery and the relationships a courier maintains to obtain tickets are with individual retailers in Texas with whom it has its own private working arrangement. Although the Texas Lottery has no authority over couriers, couriers independently publicize the lottery via their websites and advertising and have the potential to generate incremental sales.

And in the Lottery Commission’s last annual report before it banned couriers, it noted that retailers partnered with couriers were some of the state’s “top-selling sales agents.”

However, not everyone saw increasing lottery sales as a positive trend. Leading up to the courier ban, a sizable contingent of lawmakers and special interest groups had become increasingly vocal about their concerns regarding the Texas Lottery Commission’s tacit approval of lottery courier apps.

Additionally, lottery courier apps were a major theme in the Lottery Commission’s 2024-2025 Sunset Review.

The Texas Sunset Act requires the state to periodically review all state agencies to determine if they are still necessary and what changes may be needed if so. The first paragraph of the final Texas Lottery Sunset Staff Report before the ban mentioned lottery couriers but did not recommend particular policy changes. Instead, it advised the Lottery Commission to be more proactive in rulemaking and bringing concerns to the Texas Legislature.

In its response to the recommendations, the Texas Lottery Commission punted any “direction regarding lottery ticket courier services” to the legislature. However, increased scrutiny and pressure from the Texas Governor’s office prompted the Lottery Commission to proactive ban couriers.
